RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT
IMPORTANT – READ CAREFULLY BEFORE ACCEPTING
This Release of Liability, Waiver of Claims, Assumption of Risk and Indemnification Agreement (“Agreement”) applies to all teams, coaches, players, parents/guardians, and participants involved in any event, tournament, league, or program operated by SESD Basketball Tourneys (“SESD”).
By accepting this Agreement during registration, the undersigned coach represents and warrants that they have authority from their team, players, and parents/guardians to agree to these terms.
1. ASSUMPTION OF RISK Participation in youth basketball tournaments involves inherent risks, including, but not limited to:
2. RELEASE OF LIABILITY On behalf of the team, its players, parents/guardians, heirs, representatives, and assigns, the undersigned hereby releases, waives, discharges, and covenants not to sue:
from any and all liability, claims, demands, actions, damages, losses, or causes of action arising out of or related to participation in SESD events, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
3. INDEMNIFICATION The undersigned agrees to indemnify, defend, and hold harmless the Released Parties from any claim brought by or on behalf of any player, parent, spectator, or team member arising out of participation in an SESD event, including reasonable attorney’s fees and costs.
4. MEDICAL ACKNOWLEDGMENT The undersigned certifies that all players are physically able to participate and that no medical conditions exist that would create additional risk. SESD and the Released Parties do not provide medical insurance coverage. All medical expenses are the responsibility of the participant.
Emergency medical treatment may be administered if deemed necessary, and financial responsibility for such treatment is accepted.
5. MEDIA RELEASE Permission is granted for SESD Basketball Tourneys to use photographs, video, and likenesses of participants for marketing, promotional, and advertising purposes without compensation.
6. ELECTRONIC ACCEPTANCE. By clicking “Accept” or otherwise electronically agreeing during registration, the undersigned acknowledges that this Agreement is legally binding and equivalent to a signed written agreement.

- SESD Basketball Tourneys
- Avera Sports Center
- CYAL Academy
- Impact Sports Center
- Sioux Falls School District
- Tea Area School District
- Harrisburg School District
from any and all liability, claims, demands, actions, damages, losses, or causes of action arising out of or related to participation in SESD events, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.
